Understanding Traffic Citations and Your Record

What a Traffic Citation Is and How It Works

A traffic citation is an official notice that you have broken a traffic law. When a police officer pulls you over and writes you a ticket, that document is your citation. It records what traffic rule you allegedly violated, where and when it happened, and what officer issued it. The citation is not a conviction—it's a formal charge that starts a legal process.

Traffic citations come in different forms depending on what you did wrong. A speeding ticket is one common type. Another is a citation for running a red light, failing to stop at a stop sign, or driving with an expired license. Some citations are for equipment violations, like having a broken taillight or windshield wiper. Others might be for distracted driving, such as texting while driving, or for parking violations.

When an officer hands you a citation, they are documenting the alleged violation. The citation will show details like your name, driver's license number, vehicle information, the specific violation code, and the officer's badge number. It will also include instructions on what to do next—usually whether you should pay the fine, contest the ticket in court, or take a defensive driving course.

The citation itself does not automatically become part of your driving record. What happens next depends on your choices and actions. You can pay the fine (which often means admitting guilt), you can contest the ticket in traffic court, or in some cases, you can take a course that might prevent the citation from affecting your record. Each choice has different consequences for your record and your driving history.

Practical Takeaway: A traffic citation is the starting point of a legal process, not a final decision. Understanding what information is on your citation and what options you have is the first step toward making an informed choice about how to respond.

How Traffic Citations Affect Your Driving Record

Your driving record is a file maintained by your state's Department of Motor Vehicles (DMV) or equivalent agency. It tracks your driving history, including accidents, violations, and citations. When you receive a traffic citation, it may be reported to this record, but only under certain conditions and after certain steps are completed.

The way a citation affects your record depends on several factors. First, it depends on what you do with the citation. If you pay the fine, most states consider this an admission of guilt, and the violation is typically added to your driving record. If you contest the citation and lose in court, it also goes on your record. If you win in court, the citation is usually dismissed and may not appear on your permanent record, though some states keep a record of dismissed cases for a limited time.

Second, it depends on the type of violation. Minor violations like parking tickets often do not affect your driving record at all—they only require payment. Moving violations like speeding or running a red light typically do affect your record. More serious violations like reckless driving or driving under the influence (DUI) have greater impact on your record and can result in license suspension or revocation.

Third, it depends on your state's specific rules. Some states are more lenient about what goes on your record. Others are stricter. Some states allow first-time offenders to take a defensive driving course to keep a citation off their record. Others do not offer this option. Your state's DMV website can tell you the specific rules that apply where you live and drive.

Citations on your driving record typically stay there for three to five years, though this varies by state and the severity of the violation. Serious violations may remain longer. Even after they age off your record, they may still affect your insurance rates for a period of time, and they can still be considered if you are charged with a new violation.

Practical Takeaway: A citation does not automatically go on your driving record. Your actions after receiving it—whether you pay, contest it, or take a course—determine whether and how it affects your record. Understanding your state's specific rules is essential to making the right choice.

Understanding Fines, Points, and Insurance Impact

When you receive a traffic citation, you typically face a fine—a monetary penalty. The amount of the fine depends on the violation. Speeding violations might result in fines ranging from $50 to several hundred dollars, depending on how far over the speed limit you were driving. More serious violations carry higher fines. In some states, fines increase if you have prior violations on your record within a certain time period.

Many states also use a points system for traffic violations. Each type of violation carries a certain number of points. A minor speeding violation might be worth two or three points, while reckless driving might be worth four to six points. These points accumulate on your driving record. If your points reach a certain threshold—often 12 to 15 points within a set time period—your license can be suspended. This means you are legally prohibited from driving.

Beyond fines and points, traffic citations affect your insurance rates. Insurance companies review your driving record when determining your premiums. A citation for a moving violation typically results in a rate increase. The amount of the increase depends on the severity of the violation and your insurance company's specific policies. Some companies increase rates by 10 to 30 percent or more for a single violation. The increase usually lasts three to five years, even after the citation ages off your driving record.

Different violations have different insurance impacts. Speeding tickets generally result in smaller rate increases than violations involving accidents or unsafe driving like reckless driving. A DUI or other serious violation can result in dramatic rate increases and may even cause your insurance company to cancel your policy. Some drivers find they can no longer obtain standard insurance coverage and must use high-risk insurance pools, which charge much higher premiums.

The cumulative effect matters. One citation might increase your insurance by 15 percent. Two citations in three years might increase it by 35 percent or more. This is why managing traffic citations carefully is important for your long-term driving costs and record.

Practical Takeaway: Traffic citations carry three main costs: the fine you pay directly, points that accumulate toward license suspension, and insurance rate increases that may last years. Understanding all three types of consequences helps you evaluate your options when responding to a citation.

Your Options When You Receive a Citation

When you receive a traffic citation, you generally have three main options: you can pay the fine, you can contest the citation in court, or you can look into other programs your state or jurisdiction may offer.

Paying the fine is the most straightforward option. It is fast and requires minimal effort. You simply pay the amount specified on the citation by the due date. However, paying the fine typically means you are admitting guilt, and the violation goes on your driving record. This results in points being added to your record and typically leads to an increase in your insurance rates. Before choosing this option, consider whether the long-term cost of increased insurance rates exceeds the cost of the fine itself.

Contesting the citation means going to traffic court. You appear before a judge and can argue that you did not commit the violation, or that there were circumstances that should be considered. You can present evidence, question the officer, and present your own testimony. If you win, the citation is dismissed and does not go on your record. If you lose, the violation is added to your record, and you must still pay the fine. Going to court requires time and preparation, and you may want to consider whether it is worth your effort based on the strength of your case and the potential consequences.

Some states and jurisdictions offer defensive driving courses or traffic school. If you complete an approved course, the citation may be dismissed or kept off your record, depending on your state's rules. This option is often available only for minor violations and only if it is your first or second violation within a certain time period. You must pay tuition for the course, which costs money and time, but it may prevent the violation from appearing on your record and affecting your insurance rates.

A few states offer a "conviction without a record" option for first-time offenders. You admit to the violation and pay the fine, but the conviction does not go on your permanent driving record. This offers a middle ground: you resolve the case quickly but avoid the long-term impact on your record and insurance.

Some citations can be reduced. You might negotiate with the prosecutor or judge to have the charge reduced to a lesser violation that carries fewer points or a smaller fine. This requires going to court and making a request, but it is possible in many jurisdictions.

Practical Takeaway: You have real choices when responding to a citation.
